SUPERBA TERMS OF SERVICE

These Terms of Service ("Terms") are a legally binding agreement between you and PBD LLC ("Superba," "we," "us"), located at 3150 Wilshire Blvd., Los Angeles, CA 90010.

Superba is a mobile running and fitness social application that may include location-based features, maps, friend interactions, activity summaries, and augmented reality ("AR") capture experiences such as AR stat-cards and camera overlays (collectively, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility; No Children

The Services are not directed to children. You may not use the Services if you are:

• under 13 years old (United States and most jurisdictions), or
• under 14 years old (Republic of Korea).

If you are under the age required to consent to the processing of personal data in your country (including 16 in certain jurisdictions), you may not use the Services unless permitted by applicable law and you have obtained any required parental consent.

We may suspend or terminate accounts we reasonably believe are used by underage users.

2. Important Safety and Health Notice (Running, Outdoor Use, and AR)

Running, outdoor activity tracking, maps, and AR camera features can create safety risks. You agree that you will:

• Never use the Services while driving or operating machinery.
• Use caution when running or walking outdoors. Do not stare at the screen while crossing streets or navigating traffic, stairs, hills, or uneven terrain.
• If using AR camera features, stop moving when possible before recording or viewing AR overlays.
• Follow all laws, posted signs, and venue rules. Do not trespass.

Fitness / Health Disclaimer

The Services are provided for general fitness and informational purposes only and are not medical advice, diagnosis, or treatment. You should consult a qualified professional before starting any fitness program. Use the Services at your own risk.

Assumption of Risk

Physical activity and outdoor navigation involve inherent risks (including injury, falls, collision, heat illness, dehydration, and other hazards). You assume all risk from your activity and your use of the Services.

No Waiver of Non-Waivable Rights

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law. Where prohibited, we do not exclude liability for gross negligence or willful misconduct.

3. Acceptance of Terms; Privacy Policy

By using the Services, you agree to comply with these Terms and our Privacy Policy (below), which forms part of this agreement.

4. Accounts and Security

Some features require an account ("Account"). You agree to:

• provide accurate information and keep it updated;
• keep your login credentials confidential; and
• promptly notify us of suspected unauthorized access.

You are responsible for all activity under your Account.

5. Location-Based Features

Superba may use location information to provide features such as:

• route mapping and activity visualization,
• nearby/friend interactions,
• map discovery and activity markers.

You control location permissions in your device settings. If you disable location permissions, some features may not work.

6. Integrations with Apple Health / Google Fit (If You Enable Them)

If you choose to connect Apple HealthKit or Google Fit (or similar services), Superba may read and/or write permitted fitness data to provide features such as activity summaries and tracking.

You can enable or disable these integrations at any time in your device settings or within the relevant health/fitness app permissions.

7. User Content and Social Features

"User Content" means content you submit or make available through the Services, such as:

• profile information (e.g., username, photo),
• posts, comments, reactions,
• activity summaries you share,
• AR recordings/stat-cards you publish,
• messages to other users.

You are solely responsible for your User Content and represent and warrant that:

• you own it or have all necessary rights and permissions to submit it;
• it does not violate any law or third-party rights (including privacy/publicity rights); and
• you will not upload content that is unlawful, infringing, deceptive, or harmful.

8. Prohibited Conduct

You agree not to:

• harass, threaten, stalk, dox, exploit, or impersonate others;
• share private personal information of others without permission;
• upload malware, spam, or attempt to disrupt the Services;
• reverse engineer, decompile, disassemble, or bypass security measures except where the law expressly permits;
• scrape, harvest, or use automated tools to extract data without our permission;
• cheat, falsify activity/location data, or manipulate the Services.

9. License You Grant to Superba

You retain ownership of your User Content. By submitting User Content, you grant Superba a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, perform, distribute, and use your User Content, and to modify it only as necessary for technical processing/formatting, solely to:

• provide and operate the Services (including displaying shared activity and AR content);
• maintain safety, integrity, and security (including moderation, abuse prevention, troubleshooting);
• improve and develop the Services, subject to the AI training choices described in the Privacy Policy; and
• comply with legal obligations and enforce these Terms.

We do not claim ownership of your User Content.

10. Superba Intellectual Property; License to You

The Services and all content provided by Superba (excluding User Content) are owned by PBD LLC or its licensors and are protected by intellectual property laws.

Subject to your compliance with these Terms, Superba grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.

11. Purchases, Subscriptions, and Refunds (If Offered)

The Services may offer paid features, subscriptions, or one-time purchases.

11.1 Platform Terms Apply

Purchases processed through Apple App Store, Google Play, or other platforms are governed by that platform's purchase and refund policies in addition to these Terms.

11.2 Refunds and Cancellation

Refunds and cancellation/withdrawal rights depend on applicable law and platform policies. Nothing in these Terms limits any non-waivable statutory rights you may have. We will provide required recurring billing disclosures at the time of purchase.

12. Moderation; Suspension and Termination

We may (but are not obligated to) monitor, review, and remove content; restrict features; suspend or terminate Accounts; and investigate violations to protect users, the public, and the Services.

You may stop using the Services at any time. If available, you may delete your account via in-app settings or by contacting us.

Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute terms) will survive.

13. Disclaimers

To the fullest extent permitted by law, the Services are provided "AS IS" and "AS AVAILABLE." We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Services will be uninterrupted, secure, or error-free, or that activity tracking, location mapping, or AR overlays will be accurate.

14. Limitation of Liability

To the fullest extent permitted by law, Superba will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits/data/goodwill.

To the fullest extent permitted by law, Superba's total liability arising out of or relating to the Services will not exceed the greater of:

• $100 USD, or
• the amount you paid Superba in the 12 months before the event giving rise to the claim.

This section does not limit liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless PBD LLC, and its members, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of:

• your misuse of the Services;
• your User Content; or
• your violation of these Terms or applicable law.

16. Disputes; Governing Law; Venue

Except where prohibited by mandatory consumer protection laws:

• These Terms are governed by the laws of the State of California, excluding conflict-of-law rules.
• You and Superba agree to the jurisdiction of state and federal courts located in Los Angeles County, California.

If you are a resident of the Republic of Korea (or another jurisdiction with mandatory consumer forum rules), nothing in these Terms deprives you of rights or remedies available under mandatory local consumer laws, including access to a competent forum where required.

17. Copyright Complaints (DMCA)

If you believe content on the Services infringes your copyright, send a notice to:

This Privacy Policy explains how we collect, use, share, and retain information when you use Superba.

1. Scope

This Policy applies to Superba mobile apps, any websites we operate for Superba (if any), and related purchases, support, and communications.

2. Information We Collect

We collect the categories of information below, depending on what you use and what permissions you grant.

2.1 Account and Identifiers

• username and internal account ID
• email address and authentication tokens (if you sign in using Apple/Google)
• age or age-range (to verify eligibility)

2.2 Location Data (Core to Superba)

• precise GPS location (if you grant permission) used for route tracking, mapping, and location-based features
• background location data (only if you explicitly enable it)
• approximate location inferred from IP address (for web/support/security)

2.3 Fitness and Activity Data

Depending on features you use, we may collect:

• run/walk activity metrics (e.g., distance, duration, pace, timestamps)
• routes and movement paths (derived from location)
• achievements and in-app interactions related to activity

If you connect Apple HealthKit / Google Fit, we may read and/or write permitted fitness data based on your consent and device settings.

2.4 Camera and AR Capture Data (If You Use AR Features)

If you use AR camera features, we may process:

• camera images/video frames used to render or record AR overlays
• device sensor data (e.g., motion sensors)
• AR session metadata (timestamps, tracking quality, lighting estimates)

Important notice: AR capture may include personal information visible in the scene (faces, license plates, interiors, addresses). We do not guarantee automatic blurring of such information.

2.5 User Content and Social Data

• posts, comments, reactions, messages
• shared activity summaries and media
• friend connections and interactions (if enabled)

2.6 Usage and Device Data

• device model, OS version, app version, language
• IP address, timestamps, logs
• feature usage, diagnostics, performance metrics, crash reports

2.7 Purchases (If Offered)

• subscription status, product identifiers, purchase history, receipts

Payment details are generally processed by Apple/Google or another payment processor; we receive limited purchase metadata.

3. How We Use Information

We use information to:

• provide and operate the Services (including route tracking, maps, and social features);
• render and record AR overlays when you choose to use AR features;
• process purchases and manage subscriptions/entitlements (if offered);
• provide customer support and communicate updates;
• prevent fraud, abuse, and security incidents; enforce Terms;
• analyze performance, fix bugs, and improve reliability.

4. AI / Machine Learning Training

4.1 Separate Purposes

We separate:

• processing needed to provide the Services you request (tracking, maps, AR rendering), from
• optional use of certain data to improve the Services and train/evaluate our own AI/ML systems.

4.2 Default OFF; Opt-In Required

By default, we do not use your raw location routes, health/fitness data, or raw camera/AR scene recordings for AI/ML training.

We will use such data for training/improvement only if you explicitly opt in through an in-app setting (e.g., Settings → Privacy → "Contribute Data for AI Improvement").

You may withdraw consent at any time. Withdrawal applies going forward.

4.3 What Training Data May Include (If You Opt In)

If you opt in, training/improvement data may include:

• location-derived routes and activity patterns;
• fitness metrics (distance/pace/time) you generate in-app;
• AR capture recordings and AR session metadata;
• derived representations (e.g., embeddings, labels, aggregated statistics).

Because this data can be sensitive, do not opt in if you are uncomfortable with these risks.

4.4 Retention and Safeguards

We apply safeguards designed to reduce risk, including access controls and retention limits. We keep training data only as long as reasonably necessary for the purposes described, then delete or de-identify it where feasible.

5. How We Share Information

We share information only as described below.

5.1 Service Providers

We share information with vendors that help us operate the Services (hosting, analytics, crash reporting, moderation, customer support, email delivery, payment processing). They are contractually restricted to use data only to provide services to us.

5.2 Other Users and the Public

If you use social features, we may share certain information (such as username, posts, shared activity summaries, and reactions) with other users based on your sharing and visibility settings.

5.3 Legal and Safety

We may disclose information to comply with law, respond to valid legal requests, investigate abuse, protect safety, and enforce our Terms.

5.4 Business Transfers

If we are involved in a merger, acquisition, reorganization, financing, bankruptcy, or sale of assets, information may be transferred as part of that transaction.

We do not sell your personal information for money. We do not share your personal information with third parties for their direct marketing purposes.

6. International Transfers

We operate in the United States. If you use the Services from outside the U.S., your information may be transferred to and processed in the U.S. and other countries where we or our service providers operate. Where required by law, we will provide appropriate notices and obtain consent for overseas transfers.

7. Your Choices and Rights

7.1 Permissions

You can control camera, location (including background location), motion sensors, photos, and notifications through your device settings. If you disable certain permissions, some features may not work.

7.2 AI Training Consent

AI training use of sensitive data is default OFF and requires opt-in. You can withdraw consent at any time in settings.

7.3 Access, Deletion, Correction

Depending on where you live, you may have rights to access, delete, or correct personal information, and to withdraw consent. To submit requests, email hello@pbd.team.

8. Data Retention

We retain personal information only as long as necessary for the purposes described, including to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. We may retain de-identified or aggregated data longer.

9. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information. No system is perfectly secure.

10. California Privacy Notice (CCPA/CPRA)

If you are a California resident, you may have rights to:

• request access to the personal information we collect about you;
• request deletion of certain personal information;
• request correction of inaccurate personal information; and
• opt out of "sale" or "sharing" of personal information for cross-context behavioral advertising.

Superba's core functionality is activity tracking and social sharing. If we engage in cross-context behavioral advertising in the future, we will provide an opt-out mechanism and update this Policy. To exercise California rights, email hello@pbd.team with subject "California Privacy Request." We will not discriminate against you for exercising your rights.

11. Republic of Korea Notice

If you are in the Republic of Korea, you generally have rights to be informed, access, correct, delete, and withdraw consent regarding personal information. To exercise rights or ask questions, contact hello@pbd.team. Where required by Korean law, we will provide specific disclosures and obtain consent for overseas transfers and other processing activities.

12. Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will provide reasonable notice through the app or other appropriate means.
