SHOTUP AI TERMS OF SERVICE
These Terms of Service ("Terms") are a legally binding agreement between you and PBD LLC ("Shotup AI," "we," "us"), located at 3150 Wilshire Blvd., Los Angeles, CA 90010.
Shotup AI is a mobile application and related services that help users organize, analyze, search, and interact with user-provided content such as screenshots/photos, text, and chat-like interactions using AI-powered features (collectively, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility; No Children
The Services are not directed to children. You may not use the Services if you are:
- under 13 years old (United States and most jurisdictions), or
- under 14 years old (Republic of Korea).
If you are under the age required to consent to the processing of personal data in your country (including 16 in certain jurisdictions such as parts of the EEA), you may not use the Services unless permitted by applicable law and you have obtained any required parental consent.
We may suspend or terminate accounts we reasonably believe are used by underage users.
2. Acceptance of Terms; Privacy Policy
By using the Services, you agree to comply with these Terms and our Privacy Policy (below), which forms part of this agreement.
3. Your Account; Security
Some features require an account ("Account"). You agree to:
- provide accurate account information and keep it updated;
- keep your login credentials confidential; and
- promptly notify us of suspected unauthorized access.
You are responsible for all activity that occurs under your Account.
4. Your Content and Responsibilities
Shotup AI works with content you provide. You are responsible for your content and for using the Services lawfully and safely.
4.1 Your Content
"User Content" means any content you upload, import, submit, or otherwise make available through the Services, including screenshots, photos, images, text, notes, chat messages, prompts, and any attached files or metadata.
You represent and warrant that:
- you own your User Content or have all necessary rights, permissions, and consents to provide it to us;
- your User Content does not violate any law or third-party rights (including intellectual property, privacy, or publicity rights); and
- you will not upload sensitive content that you are not authorized to share (including third-party personal information without permission).
4.2 Prohibited Conduct
You agree not to:
- use the Services for unlawful, harmful, deceptive, or malicious purposes;
- attempt to reverse engineer, decompile, disassemble, or bypass security measures, except where the law expressly permits;
- probe, scan, or test vulnerabilities, or interfere with the Services or networks;
- use automated tools to scrape, harvest, or extract data from the Services without our permission;
- upload malware, spam, or content intended to disrupt systems;
- impersonate others or misrepresent your identity; or
- violate any applicable law or regulation.
5. AI Features and Third-Party Processing
Shotup AI uses third-party service providers to deliver AI-powered features. This may include sending portions of your User Content (such as images and text) to third-party processors to generate outputs or perform analysis.
By using the Services, you understand that:
- AI outputs may be incorrect, incomplete, or inappropriate;
- you should not rely on the Services for professional advice (including medical, legal, or financial advice);
- you are responsible for how you use AI outputs.

6. License You Grant to Shotup AI
You retain ownership of your User Content. By submitting User Content, you grant Shotup AI a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, perform, distribute, and use your User Content, and to modify it only as necessary for technical processing/formatting, solely to:
- provide and operate the Services (including indexing, search, summaries, and AI features);
- maintain safety, integrity, and security (including moderation, abuse prevention, troubleshooting);
- improve and develop the Services, subject to the AI training choices described in the Privacy Policy; and
- comply with legal obligations and enforce these Terms.
We do not claim ownership of your User Content.
7. Shotup AI Intellectual Property; License to You
The Services and all content provided by Shotup AI (excluding User Content) are owned by PBD LLC or its licensors and are protected by intellectual property laws.
Subject to your compliance with these Terms, Shotup AI grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial purposes.
You may not copy, distribute, sell, lease, sublicense, or create derivative works of the Services except as permitted by applicable law.
8. Purchases, Subscriptions, and Refunds
The Services may offer paid features, subscriptions, or one-time purchases.
8.1 Platform Terms Apply
Purchases processed through Apple App Store, Google Play, or other platforms are governed by that platform's purchase and refund policies in addition to these Terms.
8.2 Refunds and Cancellation
Refunds and cancellation/withdrawal rights depend on applicable law and platform policies. Nothing in these Terms limits any non-waivable statutory rights you may have. We will provide required subscription and recurring billing disclosures at the time of purchase.
9. Suspension and Termination
We may suspend or terminate your access to the Services if we reasonably believe you:
- violate these Terms;
- engage in fraud, abuse, or illegal activity; or
- materially harm the Services, other users, or our systems.
You may stop using the Services at any time. If the Services provide account deletion controls, you may request deletion using in-app settings or by contacting us as described in the Privacy Policy.
Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute terms) will survive.
10. Disclaimers
To the fullest extent permitted by law, the Services are provided "AS IS" and "AS AVAILABLE." We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Services will be uninterrupted, secure, error-free, or that AI outputs will be accurate or meet your expectations.
11. Limitation of Liability
To the fullest extent permitted by law, Shotup AI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits/data/goodwill.
To the fullest extent permitted by law, Shotup AI's total liability arising out of or relating to the Services will not exceed the greater of:
- $100 USD, or
- the amount you paid Shotup AI in the 12 months before the event giving rise to the claim.
This section does not limit liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless PBD LLC, and its members, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of:
- your misuse of the Services;
- your User Content; or
- your violation of these Terms or applicable law.
13. Disputes; Governing Law; Venue
Except where prohibited by mandatory consumer protection laws:
- These Terms are governed by the laws of the State of California, excluding conflict-of-law rules.
- You and Shotup AI agree to the jurisdiction of state and federal courts located in Los Angeles County, California.
If you are a resident of the Republic of Korea (or another jurisdiction with mandatory consumer forum rules), nothing in these Terms deprives you of rights or remedies available under mandatory local consumer laws, including access to a competent forum where required.
14. Copyright Complaints (DMCA)
If you believe content on the Services infringes your copyright, send a notice to:

SHOTUP AI PRIVACY POLICY
This Privacy Policy explains how we collect, use, share, and retain information when you use Shotup AI.
1. Scope
This Policy applies to Shotup AI mobile apps, websites we operate for Shotup AI (if any), and related purchases, support, and communications.
2. Information We Collect
We collect the categories of information below, depending on what you use and what you provide.
2.1 Account and Identifiers
- username and internal account ID
- email address and authentication tokens (if you sign in using Apple/Google)
- age or age-range (to verify eligibility)
2.2 Content You Provide
Shotup AI is designed to work with your content. We may collect:
- screenshots, photos, and other images you upload or import
- text you enter (prompts, notes, labels, chat messages)
- any attached files you choose to upload
- metadata associated with content (such as timestamps and file attributes; geolocation only if present in the file metadata or if you separately enable a feature that uses it)
Important notice: Your uploaded images and text may contain personal or sensitive information about you or others (e.g., faces, names, addresses, account numbers, messages). You are responsible for ensuring you have the right to upload and process such content.
2.3 Usage and Device Data
- device model, OS version, app version, language
- IP address, timestamps, logs
- in-app actions, feature usage, and performance metrics
- crash reports and diagnostic data
2.4 Purchases
- subscription status, product identifiers, purchase history, receipts
Payment details are generally processed by Apple/Google or another payment processor; we receive limited purchase metadata.
3. How We Use Information
We use information to:
- provide and operate the Services (including indexing, search, organization, summaries, and AI features);
- process purchases and manage subscriptions/entitlements;
- provide customer support and communicate updates;
- prevent fraud, abuse, and security incidents; enforce Terms;
- analyze performance, fix bugs, and improve reliability.
4. Third-Party AI Processing (Including OpenAI)
To provide AI-powered features, we may share portions of your content (images and text) with third-party processors, which may include AI model providers (for example, OpenAI), to generate outputs or perform analysis.
We share this data to:
- provide requested AI features (summaries, extraction, categorization, search enhancements, and related capabilities);
- maintain and improve the Services (subject to your choices below);
- protect the Services and prevent abuse.
We transmit data using encryption in transit. Third-party processors handle data under their own terms and privacy policies and under contractual restrictions where applicable.
5. AI / Machine Learning Training
5.1 Separate Purposes
We separate:
- processing needed to provide AI features you request; from
- optional use of your uploaded content to improve our Services and train/evaluate our own AI/ML systems.
5.2 Default OFF; Opt-In Required
By default, we do not use your uploaded images or text content for training our own AI/ML models.
We will use your content for training/improvement only if you explicitly opt in through an in-app setting (e.g., Settings → Privacy → "Contribute Content for AI Improvement").
You may withdraw consent at any time. Withdrawal applies going forward.
5.3 What Training Data May Include (If You Opt In)
If you opt in, training/improvement data may include:
- uploaded images (including screenshots/photos);
- uploaded text (including prompts and chat-like messages);
- derived representations (embeddings, labels, extracted metadata).
Because uploaded content can contain personal or sensitive information, do not opt in if you are uncomfortable with that risk.
5.4 Retention and Safeguards
We apply safeguards designed to reduce risk, including access controls and retention limits. We keep training data only as long as reasonably necessary for the purposes described, then delete or de-identify it where feasible.
6. How We Share Information
We share information only as described below.
6.1 Service Providers
We share information with vendors that help us operate the Services (hosting, analytics, crash reporting, customer support, payment processing). They are contractually restricted to use data only to provide services to us.
6.2 Legal and Safety
We may disclose information to comply with law, respond to valid legal requests, investigate abuse, protect safety, and enforce our Terms.
6.3 Business Transfers
If we are involved in a merger, acquisition, reorganization, financing, bankruptcy, or sale of assets, information may be transferred as part of that transaction.
We do not sell your personal information for money. We do not share your content with third parties for their direct marketing purposes.
7. Your Choices and Rights
7.1 Access, Deletion, Correction
Depending on where you live, you may have rights to access, delete, or correct personal information. To submit requests, email hello@shotup.ai.
7.2 AI Training Consent
AI training use of your uploaded content is default OFF and requires opt-in. You can withdraw consent at any time in settings.
7.3 Device Controls
You can control permissions in your device settings. If you deny certain permissions, some features may not work.
8. Data Retention
We retain personal information only as long as necessary for the purposes described, including to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. We may retain de-identified or aggregated data longer.
9. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect information. No system is perfectly secure.
10. California Privacy Notice (CCPA/CPRA)
If you are a California resident, you may have rights to:
- request access to the personal information we collect about you;
- request deletion of certain personal information;
- request correction of inaccurate personal information; and
- opt out of "sale" or "sharing" of personal information for cross-context behavioral advertising.
Shotup AI does not provide interest-based advertising based on your uploaded content within the app as a core feature. If we engage in cross-context behavioral advertising in the future, we will provide an opt-out mechanism and update this Policy.
To exercise California rights, email hello@shotup.ai with an appropriate subject line (e.g., "California Privacy Request").
We will not discriminate against you for exercising your rights.
11. Republic of Korea Notice
If you are in the Republic of Korea, you generally have rights to be informed, access, correct, delete, and withdraw consent regarding personal information. To exercise rights or ask questions, contact hello@shotup.ai. Where required by Korean law, we will provide specific disclosures and obtain consent for overseas transfers and other processing activities.
12. Changes to This Policy
We may update this Policy from time to time. If we make material changes, we will provide reasonable notice through the app or other appropriate means.
